Terms of Service for Kall AI: Phone Assistant

1. Acceptance of Terms

By creating an account, enabling Call Screening, or configuring conditional call forwarding to Kall AI, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue using the application immediately and deactivate carrier call forwarding (e.g. by dialing ##002#).

2. Eligibility & Permitted Use

You must be at least 18 years old and possess the legal authority to bind yourself or the business entity you represent. Kall AI is intended for commercial, professional, and business call management, including doctor clinics, retail stores, real estate agencies, independent consultants, and service contractors.

3. AI Telephony & Telecom Carrier Forwarding

Kall AI provides intelligent software-driven call handling. You acknowledge that:

• Carrier Terms: Conditional forwarding depends on your telecom service provider (such as Bharti Airtel, Reliance Jio, Vodafone Idea, or BSNL). Standard airtime charges or forwarding rates defined in your mobile plan are billed directly by your telecom operator.
• Mandatory AI Identification: To ensure compliance with consumer protection and Indian DPDPA standards, our automated voice receptionist will always state that it is an artificial intelligence assistant speaking on behalf of your business. You may not alter or bypass this statutory disclosure.
• Network Availability: Call forwarding and voice synthesis require active network coverage and cloud connectivity. Hastradar shall not be liable for calls dropped due to telecom carrier congestion or signal degradation.

4. Subscriptions, Minute Balances & Billing

Usage of Kall AI is measured in active conversation minutes. The terms governing fees and subscriptions are as follows:

• Free Trial: New registrations may receive promotional starter minutes. Unused bonus trial minutes have no cash surrender value.
• Minute Deductions: Minutes are deducted in increments corresponding to active speech synthesis and call connection duration.
• Google Play In-App Billing: Recurring monthly plans and top-up minute packs are purchased through Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the billing period via your Google Play account settings.
• Refunds: All purchases through Google Play are subject to the Google Play Refund Policy. Unused minutes upon voluntary account deletion are non-refundable.

5. Prohibited Conduct

When using Kall AI, you agree not to:

• Configure the assistant to conduct automated outbound telemarketing or unsolicited spam calls;
• Attempt to spoof caller identity or impersonate government officials, emergency personnel, or law enforcement;
• Train the business persona with unlawful, defamatory, or infringing content;
• Reverse-engineer, decompile, or extract the underlying models, prompts, or source code of Kall AI.

6. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Hastradar Consultancy and its directors, employees, or partners shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of business revenue, missed appointments, or prospective sales resulting from missed calls or carrier transmission failures.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of India. Any legal dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in New Delhi, India.
